The following document/page outlines the terms of use of the Hanco website. Before you use any of Hanco’s services, including this website, you are required to read, understand, and agree to these terms. The column on the left is all the lawyer speak (and is the legally binding part) – the column on the right is a short explanation in simpler terms (and is not legally binding).

Hanco Ink, LLC and its affiliates (“Hanco”, “we”, “us”, or “our”) provide various tools and features (the “Services”), primarily on this website and associated apps, for users engage in a variety of activities. The foregoing list of Services is not all-inclusive and may change from time to time without user notice. The following Terms of Use (“Terms”) govern the use of any and all Services we offer.

We made available some tools, such as this website, to learn about, browse and purchase products. The list of tools we make available may change. There are rules regarding the use of these tools, and this page covers them.

Applicability & Acceptance of These Terms of Use

By using the Services you agree, on behalf of yourself and any company or institution that you represent (collectively, “you”), that you have read and understand these Terms and our Privacy Policy (link found in the footer of this page). You understand that these Terms are a binding legal agreement between you and us, without limitation or qualification. If you do not agree to these Terms or our Privacy Policy, then you may not access or use the Services. We reserve the right to modify these Terms at any time. All changes will be effective immediately upon posting to the Services. All changes immediately void previous versions unless otherwise specified in Terms.

Use Restrictions

You agree that your use of the Services is subject to all applicable local, state, national, and international laws and regulations. You also agree:

  • not to submit inaccurate information via the Services (including misrepresenting your affiliations with any institution), commit fraud, or falsify information in connection with your use of the Service, or act maliciously against the business interests or reputation of Hanco;
  • not to impersonate another user or person;
  • not to sell or otherwise transfer your Services account;
  • not to harass, annoy, intimidate, or threaten any Hanco employees, contractors, agents, or representatives;
  • not to engage in activities that aim to render the Services inoperable or make their use more difficult;
  • not to attempt to gain unauthorized access to other systems from or through the Services or through the use of information gained through the use of Services;
  • not to upload, post, or transmit viruses or other harmful, disruptive, destructive softwares;
  • and not to disrupt, interfere with, or otherwise harm or violate the security of the Services or any supporting or affiliated hardware or software or systems.

You agree that the consequences of violations of this section may be so serious and incalculable that monetary compensation alone may not be a sufficient or appropriate remedy. In the event of a suspected violation we may terminate access to the Services in addition to other remedies that will be sought out to the fullest extent of the law.

Basically

There are some things you aren’t allowed to do. If you do those things, there will be consequences. They will likely be severe. If you aren’t a terrible person, you’re going to be fine.

Payment Information

Payment arrangements for purchases made through the Services must be completed at the time of purchase. If the credit or debit card information that you submit is incorrect or invalid, your payment will not be processed. We have no responsibility or liability if your credit or debit card is declined by your financial institution, or if your credit or debit card is declined in error. Refunds, if available, are solely the responsibility of Hanco, are at Hanco’s sole discretion, and are subject to Hanco’s Return Policy.

Basically

You need to pay when you order. Hanco isn’t responsible for payment issues, no matter the reason for the issue. Refunds, if available, are at Hanco’s sole discretion and are subject to Hanco’s Return Policy.

Credit Applications for “On Account” Payment

If you are a company, institution, or school, you may be eligible to purchase products “on account”. To request an account you will be required to submit a credit application. Account eligibility and approval is at Hanco’s sole discretion. Additional terms may apply. To request an application please contact Hanco at [email protected].

Basically

If you’re a school or company, you might be eligible to purchase using an account as your method of payment. To do this you have to complete an application and get approved. Approval is 100% up to Hanco. Contact us for an application.

Terms of Sale

All orders of products from Hanco are subject to these terms unless otherwise stated. Prices and availability may change without notice. Availability of products may change without notice. Availability of products may be limited and products may not be available for immediate delivery. You may not be notified if product availability is limited. Nothing on the Services constitutes an offer, but should instead be interpreted as an invitation for you to make an offer to purchase. All orders are subject to acceptance by Hanco. We reserve the right to refuse or cancel any order for any reason. We may also require additional verifications, approvals, or information before accepting any order. The Services accepting an order does not constitute Hanco accepting an order. An order is deemed accepted by Hanco when it has shipped with a 14 day recall period. Hanco does not calculate or collect charges for international taxes/duties/fees. Hanco does not pay any international taxes/duties/fees. International taxes/duties/fees are often due upon delivery and are the responsibility of the receiver. Disclaimer of Warranties: TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL PRODUCTS ARE PROVIDED “AS IS” AND WITHOUT ANY WARRANTY OR CONDITION OF ANY KIND. HANCO EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, EXPRESSED OR IMPLIED, WITH RESPECT TO THE PRODUCTS. NO ADVICE OR INFORMATION, ORAL OR WRITTEN, OBTAINED BY YOU FROM HANCO OR IN ANY OTHER WAY FROM THE SERVICES CREATES ANY WARRANTY.

Basically

All orders are subject to these terms. Prices and availability change and you might not be made aware. Some products have limited availability so they might not be available to ship right away, and you might not be notified. Sometimes we will need to ask for more information to process an order. We can cancel any order for any reason at any time. Any additional charges related to international shipments/transactions are not Hanco’s responsibility – we don’t collect or pay any of these fees, they are often due upon delivery. There is no warranty on any product (believe it or not, this is an art industry wide practice).

Termination of and Modifications to the Services

Hanco reserves the sole and absolute right to at its discretion modify, suspend, or discontinue at any time, with or without notice, the Services (or any part thereof).

Basically

We can change or discontinue things whenever we want and we don’t have to say anything about it.

Your Account

The Services may require you to register or create an online account. During this process you must provide information. You agree to maintain this information and keep it up to date, true, and accurate. If we believe any information is untrue or inaccurate we have the right to suspend or terminate your account. Hanco has the right to suspend or terminate your account for any reason at any time with or without notice. If you submit someone else’s information you warrant that you have that person’s permission to provide us with that information. You are responsible for maintaining the confidentiality and security of your account. You agree to immediately notify Hanco of any known or suspected unauthorized use of your password or account or any known or suspected breach of security. You agree to log out from your account at the end of each session. Hanco will not be liable for any injury, loss, or damage of any kind arising from or relating to your failure to comply with these clauses or for any acts or omissions by you or someone else using your account or password.

Basically

You’re probably going to need an account. You agree to keep it safe and secure. Hanco can suspend or terminate or delete your account at any time for any reason (but don’t worry, this isn’t something we want to do). Hanco isn’t responsible if your account is compromised, but you need to tell us right away if you think it was.

Indemnity

You agree to indemnify, defend, and hold harmless Hanco, its affiliates, and its and their respective agents, officers, directors, employees, owners, contractors, representatives, consultants, suppliers, and licensors from and against any claim, demand, damage, loss, liability, complaint, action, judgment, settlement, fines, penalties, costs, and expenses, whether direct, indirect, consequential, or otherwise, and including reasonable attorneys’ fees, made by anyone in connection with your access to or use of the Services, your submission, use, or misuse of User-Generated Material or other information you provide using the Services, your order of Products using the Services, any alleged infringement of intellectual property or other right of any person or entity relating to the Services, your violation of these Terms of Use, or any other acts or omissions relating to the Services. We reserve, and you grant to us, the exclusive right to assume the defense and control of any matter subject to indemnification by you.

Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND ALL INFORMATION, CONTENT, SERVICES, AND MATERIALS PROVIDED BY OR AVAILABLE THROUGH THE SERVICES INCLUDING, WITHOUT LIMITATION, ALL MATERIAL, TEXT, PHOTOS, GRAPHICS, VIDEO, AND LINKS, ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED. HANCO DOES NOT GUARANTEE THE QUALITY, COMPLETENESS, TIMELINESS, OR AVAILABILITY OF THE SERVICES. HANCO DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT ANY DEFECTS IN THE SERVICES WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THE SERVICES AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL CONDITIONS OR COMPONENTS. HANCO IS NOT RESPONSIBLE FOR ANY TYPOGRAPHICAL ERRORS ON THE SERVICES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, HANCO EXPRESSLY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, EXPRESSED OR IMPLIED, OF ANY KIND WITH RESPECT TO THE SERVICE AND ANY PRODUCTS OR MATERIALS PROVIDED BY OR THROUGH THE SERVICE. YOUR USE OF THE SERVICES AND ANY PRODUCTS OR MATERIALS PROVIDED BY OR THROUGH THE SERVICE IS AT YOUR OWN RISK AND YOU, ALONE, ARE RESPONSIBLE FOR ANY DAMAGES THAT RESULT, DIRECTLY OR INDIRECTLY.

There is no warranty for the functionality or availability of the website or any other products or services we provide to you. We aren’t responsible if anything bad happens.

Limitation of Liability

IN NO EVENT SHALL HANCO BE LIABLE FOR AN INJURY, LOSS OR DAMAGE, WHETHER DIRECT, INDIRECT, CONSEQUENTIAL OR INCIDENTAL, ARISING OUT OF THE USE, OR THE INABILITY TO USE, SERVICES OR PRODUCTS OR GOODS PROVIDED HEREUNDER WHETHER SUCH DAMAGE RESULTS FROM BREACH OF WARRANTY, NEGLIGENCE OR ANY OTHER CAUSE AND WHETHER OR NOT SELLER KNEW OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH INJURY, LOSS OR DAMAGE.

We aren’t responsible if anything really bad happens.

No Waiver; Force Majeure

The failure of Hanco to exercise or enforce any right or provision of these Terms of Use (“Terms”) shall not constitute a waiver of said right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an officer of Hanco. Hanco shall not be deemed to be in default of any provision of these Terms or for failure in performance resulting from acts or events beyond the reasonable control of Hanco and arising without its fault or negligence, including, but not limited to, acts of God, civil or military authority, interruption of electric or telecommunication services, civil disturbances, widespread illness, acts of war or terrorists, strikes, fires, floods or other catastrophes.

Basically

If we don’t enforce our own Terms 100% of the time that doesn’t make them any less valid. Also, it’s not our fault if our business is impacted because something serious happens in the world that is outside our control (COVID-19 is an excellent recent example of this).
